This is us working hard on a Friday evening for an urgent motion that was being heard in court the following Tuesday.

Our client, a large commercial tenant (restaurant), was affected by the Covid-19 pandemic and fell into rent arrears. The commercial landlord decided to evict our client. BUT…during the pandemic, the legislature passed a moratorium which forbid the eviction of commercial tenants during the non-enforcement period as set out under part IV of the Commercial Tenancies Act. We will be arguing our motion before a Judge on Tuesday to hold the commercial landlord accountable for its breach of the Commercial Tenancies Act.
